ANJL tuomitsee päätöksen estää online-uhkapelisivustot Rio de Janeirossa

The National Association of Games and Lotteries (ANJL) has strongly criticized the recent decision by Brazil’s National Telecommunications Agency (Anatel) to block unauthorized online gambling and sports betting sites in the State of Rio de Janeiro. ANJL argues that the action undermines fundamental legal principles and creates uncertainty in a market undergoing federal regulation.

The ANJL said that it had “learned with dismay” of the news. According to the association in addition to “potentially cutting off access overnight to millions of players from over a hundred betting platforms, this decision violates fundamental legal principles, notably those of due process and the right to a fair hearing.”

The ANJL went on to say that:

“The suspension order against these sites has been issued without these companies ever having the opportunity to defend themselves, either in the judicial process or before Anatel, at a time when the market is undergoing regulation in Brazil. Operators nationwide were granted a transition period until December 31, 2024, under Law 14,790/2023.

“This creates a scenario of dangerous legal uncertainty, as federal regulation naturally supersedes the legislation of the State of Rio de Janeiro and Loterj’s licensing terms.”

The association concluded by saying that it  was “important to highlight that in 2020, the Brazilian Supreme Federal Court (STF) ruled that lottery operations are not exclusively under the Union’s jurisdiction but can also be conducted by states and the Federal District, with regulatory power solely vested in the Union. Therefore, the state must adhere to federal rules and not misinterpret them.”

The ANJL represents companies that operate legal games and lotteries in Brazil or are in the process of legalization. ANJL’s mission is to defend the interests of these companies operating under national legislation.
